- Divorce
A divorce is basically a “dissolution of marriage.” The law recognizes a no-fault divorce standard that allows one of the parties involved to dissolve the marriage without the hassle of having to prove that the other party is guilty of any blame or responsibility in court. However, there are many factors that can complicate a divorce; in a standard marriage, the court will generally want to know whether there is still any chance of the married couple making an effort to rescue their union or whether the marriage in question simply cannot be saved. Based on the answer to this question, the court will either move in favor or dissolving the marriage or employ other options. There are situations that make the process of dissolving the marriage more complicated such as when a no-fault standard is not recognized, so your family law attorney has to treat such a situation differently. In order for the court to grant a divorce in certain cases, both parties must agree to it or there must be proof or certain circumstances such as adultery, abandonment, physical abuse or drug abuse. There are other aspects of a divorce that can make it differ from others such as complex high net worth divorces, annulments, post-divorce disputes, separation agreements, division of marital assets, and others.
- Child Custody

Most states base their child custody laws on the Uniform Child Custody Act (UCCA,) this was done in an effort to minimize interstate issues. The court recognizes both legal and physical custody. According to legal custody laws, the parents or guardians of a child have the right to make major life decisions such as where to send him or her to school and about the child’s religious upbringing. Physical custody, on the other hand, has to do with the decision of which parent or guardian the child will live with. One of the possibilities is that one of the parents will be granted sole custody; another possibility is that both parents will share joint custody of the child. There are, of course, other possibilities for the court to consider and they will do so according to what is best for the child. For example, when the parents are no longer alive or they are simply not a good option for the child because of drug abuse or other factors, other family members or someone else appointed by the court may be granted custody.
