Selling to the EU & NI? The GPSR Compliance Checklist for UK Businesses

For UK businesses exporting to the European Union (EU) and Northern Ireland (NI), compliance with the General Product Safety Regulation (GPSR) is no longer optional. With new regulatory requirements in place, failing to comply can lead to border rejections, fines, or product removals from marketplaces like Amazon and eBay.

To help businesses navigate these changes, here’s a step-by-step GPSR compliance checklist ensuring smooth entry into the EU and NI markets.

Step 1: Understand GPSR and CE Marking Requirements

The GPSR, effective from December 13, 2024, mandates stricter safety requirements for products sold in the EU and NI. Key aspects include:

✅ Ensuring product safety through risk assessments and documentation. ✅ Providing clear traceability details, including manufacturer and importer information. ✅ Meeting CE marking requirements, if applicable, for product categories requiring conformity to EU directives.

If your product is covered under specific EU regulations (such as toys, electronics, or machinery), it must meet CE marking standards in addition to GPSR.

Step 2: Appoint an EU Authorised Representative

Since the UK is no longer part of the EU, businesses exporting to EU and NI markets must designate an EU Authorised Representative (AR). This representative is legally responsible for ensuring compliance and serves as the official contact for regulatory authorities.

Without an EU Authorised Representative, your products may be rejected at customs or removed from marketplaces.

Step 3: Create an EC Declaration of Conformity

For businesses selling products that require CE marking, an EC Declaration of Conformity is essential. This document confirms that the product meets all relevant EU safety directives.

Key elements of an EC Declaration of Conformity include:

Product identification details.

Manufacturer’s name and contact information.

Compliance with applicable EU regulations and standards.

Signature from an authorized individual.

Step 4: Assign a GPSR Responsible Person

Under GPSR, all products sold in the EU must have an GPSR Responsible Person within the EU. This individual or entity ensures:

✅ The availability of technical documentation and safety compliance records. ✅ Prompt responses to inquiries from market surveillance authorities. ✅ Management of any necessary product recalls or safety warnings.

Failing to appoint a GPSR Responsible Person can result in delays, penalties, or product bans in the EU.

Step 5: Ensure Proper Labeling and Traceability

To comply with GPSR and CE marking rules, product packaging must include:

Manufacturer’s name, address, and contact details.

Importer details (if the manufacturer is outside the EU/NI).

Traceability markings such as batch numbers and serial codes.

Warnings and safety information (if applicable).

Step 6: Stay Updated on Regulatory Changes

EU regulations are continuously evolving, and businesses must stay informed on updates to GPSR, CE marking requirements, and industry-specific regulations.

💡 Euverify provides real-time updates and automated compliance solutions, ensuring your business remains compliant with minimal effort.
